1. About these terms
These Terms of Service (the “Terms”) apply when you visit hiddenstitchsupply.com, use the website, create an account or place an order with Hidden Stitch Supply. By using the website or placing an order, you agree to these Terms and the policies linked below.
If you do not agree to these Terms, please do not use the website. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
2. Who we are
Hidden Stitch Supply is an Australian sole-trader business based in Melbourne, Victoria. Shopify provides the ecommerce platform used to operate this store.
3. Eligibility and accounts
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order. If you create an account, you are responsible for keeping your login details secure and for providing accurate, current information.
4. Products and availability
I take reasonable care to describe and photograph products accurately. Colours and textures may look different depending on your screen, lighting and the natural variation of the material. Product measurements are approximate and may vary within any tolerance stated in the relevant size guide.
Products and sizes are subject to availability. Adding an item to your cart does not reserve it. I may correct an obvious description, pricing or inventory error before accepting an order. If an error affects an order after payment, I will contact you and offer an appropriate correction or a full refund.
5. Orders
When you submit an order, you are offering to buy the items in your cart. An automated order acknowledgement confirms that the order was received, but does not necessarily mean it has been accepted. The order is accepted when I send an order confirmation or dispatch confirmation, whichever occurs first.
I may decline or cancel an order where an item is unavailable, payment cannot be authorised, there is an obvious pricing or listing error, delivery is not available to the address provided, fraud or misuse is reasonably suspected, or accepting the order would breach a legal obligation. If payment has already been taken for a cancelled order, I will refund it promptly to the original payment method.
Please review your order and delivery details carefully before submitting it. If you need to request a change or cancellation, contact me as soon as possible. I cannot guarantee a change once fulfilment has started.
6. Prices, payment, duties and taxes
Prices are displayed in the currency selected for your market. The checkout shows the amount payable before you place the order, including applicable duties and taxes and any delivery charge. You authorise the selected payment provider to charge that amount when you submit the order.
Hidden Stitch Supply’s current shipping charges and duty arrangements are explained on the Shipping and Returns page. You should not be asked to pay an additional duty, tariff or import tax when the order arrives. If a carrier or customs office requests an extra payment, contact me before paying it so I can investigate.
7. Shipping and delivery
Delivery options and estimates are shown at checkout where available. Delivery dates are estimates, not guarantees, because carrier and customs delays can occur outside my reasonable control. I will provide reasonable help if an order is delayed, lost or damaged in transit.
Some orders may be fulfilled from outside Australia. Please read Shipping and Returns before ordering for current fulfilment locations, delivery estimates and what to do if there is a problem.
8. Returns and Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement or refund, and compensation for reasonably foreseeable loss or damage.
Your rights under the Australian Consumer Law are separate from, and are not limited by, any change-of-mind return option. The Refund Policy explains how to report a faulty, incorrect or misdescribed item and any additional return options offered by Hidden Stitch Supply. Please contact me before sending an item back so I can confirm the appropriate return path.
9. Acceptable use
You may use this website only for lawful purposes. You must not interfere with the website’s operation or security, introduce malicious code, scrape or access the website by automated means in a way that places an unreasonable load on it, impersonate another person, use false payment or delivery information, or use the website to violate another person’s rights.
I may restrict or suspend access where reasonably necessary to protect the website, customers or the business from unlawful activity, fraud, misuse or a security threat.
10. Intellectual property
Unless otherwise stated, the website content created for Hidden Stitch Supply, including text, branding, graphics and original photography, is owned by or licensed to Hidden Stitch Supply and is protected by applicable intellectual property laws. You may view and use the website for personal shopping purposes, but you must not reproduce, sell, publish or commercially exploit this content without permission.
11. Third-party services and links
The store relies on third-party services, including Shopify and payment, delivery and analytics providers. Those providers may apply their own terms and privacy notices to the services they supply. Links to third-party websites are provided for convenience and do not mean that Hidden Stitch Supply controls or endorses their content.
12. Privacy
Your use of the website and handling of personal information are also governed by the Privacy Policy. By providing personal information, you confirm that you are authorised to provide it and that it is accurate to the best of your knowledge.
13. Website availability and liability
I aim to keep the website accurate, secure and available, but uninterrupted or error-free access cannot be guaranteed. The website may occasionally be unavailable for maintenance, technical problems or events outside reasonable control.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of the Australian Consumer Law, or any other liability that cannot lawfully be excluded or limited. To the extent permitted by law, Hidden Stitch Supply is not responsible for loss caused by your unlawful use of the website, your failure to protect account credentials, or events outside its reasonable control.
14. Changes to these terms
I may update these Terms to reflect changes to the store, its services or the law. The current version and effective date will always be shown on this page. A change will not alter the terms that applied to an order already accepted unless the change is required by law or you agree to it.
15. Severability and waiver
If part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply. A delay in enforcing a right does not waive that right.
16. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia, and the laws of the Commonwealth of Australia that apply in Victoria. The courts of Victoria and courts entitled to hear appeals from them have non-exclusive jurisdiction. This does not prevent you from relying on any mandatory consumer protection available in the place where you live.
